Welcome to ShareCar. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Techtenstein Services Pvt Ltd ("ShareCar," "we," "us," or "our"), governing your access to and use of the ShareCar website (sharecar.net) and mobile application (the "Platform").

PLEASE READ CAREFULLY: By accessing, downloading, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.

FOR USERS IN THE UNITED STATES: THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND A CLASS ACTION WAIVER (SECTION 10). IT AFFECTS YOUR RIGHTS ON HOW TO RESOLVE DISPUTES WITH US.
CRITICAL NOTICE: ShareCar is strictly a technology platform that connects Drivers and Passengers. We are NOT a transportation carrier, taxi service, or travel agency. We do not own vehicles or employ drivers.

1. Definitions

  • "Driver" refers to a member using the Platform to offer a ride to share costs.
  • "Passenger" refers to a member using the Platform to book a seat in a Driver's vehicle.
  • "Cost Contribution" refers to the amount paid by the Passenger to the Driver towards the cost of the trip (fuel, tolls, etc.).
  • "Service Fee" refers to the fee charged by ShareCar for the use of the Platform.

2. Nature of the Service (Cost Sharing)

2.1. Strictly Non-Profit: The Service is designed solely for cost-sharing. Drivers are prohibited from making a profit from trips. The Cost Contribution must not exceed the running costs of the vehicle.

2.2. The Driver agrees not to request a Cost Contribution higher than the amount allowed by local tax authorities (e.g., IRS in US, HMRC in UK).

2.3. ShareCar reserves the right to suspend any account suspected of using the Platform for commercial gain or unlicensed taxi services.

2.4. Compliance with Local Laws: You agree to use a private vehicle in accordance with local regulations. Using a private vehicle for commercial "for-hire" purposes without proper licensing is strictly prohibited.

3. User Eligibility & Accounts

3.1. Age: You must be at least 18 years old to create an account.

3.2. Verification: You agree to provide accurate, current, and complete information. ShareCar requires Government ID verification (Passport, Driver's License) to maintain safety standards.

3.3. Account Security: You are responsible for maintaining the confidentiality of your login credentials.

4. Obligations of the Driver

By offering a ride, you certify that:

  • You possess a valid driving license and are authorized to drive the vehicle.
  • The vehicle is in good working order and complies with all legal safety standards.
  • You have a valid insurance policy that covers third-party passengers and carpooling activities.
  • You will not take more passengers than the number of seatbelts available.

5. Obligations of the Passenger

By booking a ride, you agree to:

  • Pay the Cost Contribution and Service Fee in full.
  • Arrive at the pickup point on time.
  • Behave respectfully and not damage the Driver's vehicle.
  • Present valid ID if requested by the Driver for verification.

6. Payments, Cancellations & Refunds

6.1. Payments

Payments are processed securely via third-party global gateways (e.g., Stripe, PayPal). ShareCar collects the Cost Contribution on behalf of the Driver and transfers it after the trip is successfully completed.

6.2. Cancellation Policy

  • Passenger Cancellation: If you cancel more than 24 hours before departure, you receive a full refund. Late cancellations may incur a fee.
  • Driver Cancellation: If a Driver cancels, the Passenger receives a full refund. Drivers who cancel frequently may be banned.

7. Disclaimer of Liability

To the fullest extent permitted by law, ShareCar excludes all liability for any damages, losses, injuries, or claims arising out of:

  • Any agreement or interaction between a Driver and a Passenger.
  • The physical condition, safety, or legality of any vehicle.
  • Traffic accidents, delays, or route changes.
  • Force Majeure events (natural disasters, strikes, civil unrest).

We do not conduct background checks on users beyond basic ID verification. You travel at your own risk.

8. Indemnification

You agree to release, defend, indemnify, and hold harmless Techtenstein Services Pvt Ltd, its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses arising out of your breach of these Terms or your improper use of the Platform.

9. Prohibited Activities

Users shall not:

  • Use the Platform for transporting illegal goods, weapons, or hazardous materials.
  • Harass, stalk, or discriminate against other users based on race, religion, gender, or nationality.
  • Use the Platform to recruit users for other services (spam/solicitation).

10. Governing Law & Dispute Resolution

10.1 For Users in the United States

Any dispute arising out of or relating to these Terms shall be resolved by Binding Arbitration conducted by the American Arbitration Association (AAA). You agree to waive any right to a jury trial or to participate in a class action.

10.2 For Users in Europe and UK

These Terms are governed by the laws of India, provided that this does not deprive you of the protection afforded by mandatory consumer laws of your country of residence.

10.3 For Rest of the World

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts in Tirupati, Andhra Pradesh.
